DMCA Policy

[CONTROLLER LEGAL NAME] ("we," "us") respects the intellectual property rights of others and expects users of Nebula Novel (the "Services") to do the same. This DMCA Policy describes how to notify us of alleged copyright infringement and how we will respond, in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Designated agent

Notifications of alleged copyright infringement should be sent to our designated DMCA agent:

Our designated agent is registered with the United States Copyright Office. You can verify the registration at the Copyright Office DMCA Designated Agent Directory.

2. Filing a notice of infringement

To submit a takedown notice, send a written communication to our designated agent (preferred: email to hello@nebulanovel.com) that contains substantially the following:

  1. Your physical or electronic signature (typing your full name in an email is acceptable as an electronic signature).
  2. Identification of the copyrighted work you claim has been infringed. If multiple works on our site are covered by a single notice, you may provide a representative list.
  3. Identification of the allegedly infringing material, with enough detail (URL, page, message ID, or similar) for us to locate it.
  4. Your contact information — address, phone, and email — so we can reach you.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

Incomplete notices may delay our response. Knowingly making material misrepresentations in a takedown notice may subject you to liability under 17 U.S.C. § 512(f).

3. How we respond

When we receive a complete notice:

  1. We will promptly remove or disable access to the allegedly infringing material.
  2. We will notify the user who submitted the material of the takedown and provide them with a copy of the notice.
  3. We will terminate accounts of repeat infringers in appropriate circumstances. See section 5.

4. Filing a counter-notice

If you believe material you submitted has been removed in error or as a result of misidentification, you may file a counter-notice. Send it to hello@nebulanovel.com with substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and its prior location (URL or other identifier).
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if you are outside the US, the United States District Court for the District of [VENUE]), and that you will accept service of process from the person who sent the original takedown notice or their agent.

Upon receipt of a valid counter-notice:

  • We will forward it to the party who filed the original notice.
  • Unless that party files suit and provides notice within 10–14 business days, we will restore the material within that window.

Knowingly making material misrepresentations in a counter-notice may subject you to liability under 17 U.S.C. § 512(f).

5. Repeat infringer policy

In accordance with 17 U.S.C. § 512(i)(1)(A), we will terminate the accounts of users who, in appropriate circumstances, are repeat infringers. Repeat infringement is evaluated case-by-case but generally includes:

  • Two or more valid DMCA notices against the same user, or
  • A pattern of notices that suggests deliberate or reckless infringement, or
  • A court order or arbitration award establishing infringement.

A counter-notice that is later validated (either by the original complainant withdrawing or by a court ruling in the user's favor) does not count toward repeat-infringer status.

6. Other intellectual property claims

This policy addresses copyright claims under US law. For other intellectual property concerns (trademark, trade secret, right of publicity, claims under non-US law), contact hello@nebulanovel.com. We evaluate non-DMCA claims case-by-case.

7. Misuse

We treat DMCA notices seriously, but we also treat misuse seriously. Submitting bogus notices to harass users, suppress lawful speech, or gain competitive advantage is itself unlawful. We may publicly catalog notices we determine to be abusive and may refer abusive notices to law enforcement or third-party transparency efforts (for example, Lumen).
